Delhi High Court refuse to interfere in DUs open book exam

The Delhi High Court on Monday refused to interfere with Delhi University’s decision to conduct online open book exam for intermediate semesters of its law course which could not be conducted last year due to COVID-19, and said that it would not allow students to dictate terms of examination of a professional course. “I am not going to allow students to dictate the terms of exams of a professional course,” a bench of Justice Prateek Jalan said while hearing four petitions by students of second and final year of Faculty of Law, Delhi University.

The court refused to pass a direction to the university to conduct an assignment based examination instead and clarified that it would not substitute the stand taken by the university.

“Court can’t give mandatory direction to the university to conduct assignment based examination… The matter is one which university is authorised to consider. University’s policy decision can’t be interfered with by court,” it said.

The court nonetheless asked the university to declare the results of the examinations as expeditiously as possible. Law Faculty Dean Vandana told the court that the examination in question was likely to be conducted in July itself and another round of exams would be held in September for the benefit of students who are unable to sit in the first round.

Advocate Seema Dolo, appearing for DU, submitted that as approved by the Bar Council of India, the mode of examination, whether online, offline, blended or assignment based – was left to the discretion of the institute concerned.

Advocate Siddharth Seem, who appeared for a final-year law student, argued that the online open book examination for last year’s intermediate semesters II and IV was not in the interest of students.

Pressing for an assignment-based examination, the dates for the online open book examination might clash with the other entrance examinations that the final year students might take for further studies.

In this regard, the court took on record Prof Vandana’s assurance that as far as possible, the date sheet would be decided keeping in mind the dates of entrance examinations. In any event, those who cannot take the examination in July can take it in September, the court added. All four petitions were disposed of the court.

CBSE Board Exams 2021 for Class 10, 12 in offline mode will likely to be conducted in August if situation is conducive, said Education Minister.

Education Minister Ramesh Pokhriyal on June 25 shared a special message for CBSE Board Exam 2021 students. The education minister said that students who are dissatisfied with their Class 10, 12 results can appear for physical exams that would likely be conducted in August if the situation is favourable.

Education minister addresses students regarding queries of board and entrance examinations

CBSE Board Exam 2021 for Class 10, 12 has been cancelled by the Board due to the rise in COVID19 cases across the country. The Board has framed separate evaluation criteria for Class 10 and Class 12. The evaluation criteria was accepted by the Supreme Court on June 18, 2021, for Class 12. The result will be declared by CBSE by July 31, 2021.

The exam dates and other details of physical exams (if conducted) will be released by the Board in due course of time.

In a major upset, no announcement regarding JEE Main 2021 or NEET 2021 exam dates were made. The message was only to assure the students of the safety and to share the process of CBSE Result 2021 calculation. Lakhs of students are eagerly waiting for the clarity on the pending competitive exams. It may be worthy to point out here that the Education Minister did not conduct a live session. The message was a pre-recorded message for the stduents.
In the recorded message , the Education Minister has shared that the CBSE optional exams may be conducted in August or any other later date, in case situation is conducive. He has also insisted that the safety of the students is paramount to the government.

Academics ask Delhi University (DU) to cancel final-term exams. Additionally, 30 academics have written a letter to University Grants Commission (UGC). The letter is for the current chairperson of UGC, Dhirendra Pal Singh.

Moreover, the list of academics also include the former UGC chairperson, Sukhadeo Thorat. The letter appealed the UGC to cancel the final-term exams for DU final year students.

Additionally, Mr. Thorat adds in the letter, “I am hoping that as fellow teachers committed to the welfare of our students and the integrity of our examinations, you and your colleagues in the commission will take note of the widespread sentiment that this appeal represents.”

UGC released the revised guidelines for the final-term exams earlier this week. According to the guidelines, it is compulsory to conduct exams for final year students. Furthermore, the exams should be over by September.

The academics further argued that online exams or blend exams will favour students with better internet connections. They also add that the cancellation of exam will not lead to devaluation of exams. Rather, will save it from mockery.

Additionally, DU Open Book Exam was to start from July 10. But the university has now postponed the date to the month of August. This has raised questions to the working of the university. Furthermore, the Delhi High Court has also asked university to be clear on its decision.

As of now, the final-term exam of Delhi University will take place after 15th August.

Delhi University on Saturday began with the mock tests series to familiarise the final year students with the Open Book Examinations which will be held later this month.

Students complained about the various problems they faced. Some reported having not being able to find their subject papers. DU teachers have come forward to support the students. They said that they were “inundated” with panic calls from students who have “nowhere to address their queries.”

Teachers have demanded the university to “stop playing with the future and career of lakhs of students” and “cancel the open book exam in the interest of physical and mental well being of students.”

Various students took to social media platforms to address their issues and demanded cancellation of exams. Twitter and other media sites were flooded with #DUagainstonlineexams and #DUagainstOBE posts.

Delhi University Teachers Association (DUTA), in an official statement, said: “For example, there was no question paper for Economics (Honours) students. The only economics papers available were for the annual system. The annual system was last taught in 2013 for regular courses and there aren’t even repeaters now, because the span period is over.”

“The DUTA strongly condemns the incompetent University administration and demands that the University stops playing with the future and career of lakhs of students and cancels the OBE in the interest of the physical and mental wellbeing of students,” DUTA said in the statement.

Teachers also criticised University Grants Commission (UGC) and Ministry of Human Resource Development (MHRD) of their “callous” attitude. HRD Minister Ramesh Pokhriyal on June 24 had asked UGC to “revise” the exam guidelines. In the meantime, many universities have put their exams on hold.

Rajib Ray, President of DUTA, said: “I am dismayed by the Dean’s statement that “All is well!” It is better to remain unavailable than to misinform and not admit crisis.I wish to tell our students that teachers are with them. We will stand by you in this hour of crisis.”

Delhi University has released the revised datesheet for OBE 2020. Previously, exams were to begin from July 1 which were then postponed. Now, the exams for UG and PG programmes will begin from July 10. The datesheet can be downloaded from the official website.

The guidelines for open book examination were previously issued by the University of Delhi. The duration of examination is two hours, and students can take an additional one hour for downloading the question paper, scanning and uploading the answer sheets. The total duration will be 3 hours.

In order to get familiarized with this process, DU students can take mock tests, from July 4 to July 8. Each day, 3 time slots are available.

“In case of any discrepancy being noticed in the date sheets, the students may send their queries specifying all the relevant details to the Dean (Examinations) at dean_exam@du.ac.in or examviiconduct@gmail.com at the earliest so that the same may be corrected/incorporated accordingly,” the official notice reads.
